MEMO TO: Mayor and City Council (� <br />irFROM: Director of Public Works/Community Development <br />DATE: April 7, 1983 <br />SUBJECT: AMENDMENT OF CHAPTER 48, "WETLAND ZONING ORDINANCE" <br />Review of ordinance amendment procedure by staff and City Attorney <br />determined the following: <br />1) Chapter 48.02 provides the authority to amend the wetland <br />boundary if it is found a mistake was made or conditions <br />have changed since enactment of the ordinance. <br />2) Procedure set out in Chapter 40.23, Subdivision B and <br />State Statute 462.357, Subdivision 3, requires a public <br />hearing with ten days published notice and notification <br />of property owners within 350 feet before enactment of <br />amendment. <br />3) First reading can take place before public hearing is <br />held. <br />4) If boundary is not adjusted to recognize fill placed on <br />the lots prior to the enactment of the wetlands ordinance <br />then the provisions of 48.05, Subdivision 2, will prohibit <br />construction of any buildings except accessory buildings <br />on the lots in question. <br />Staff is recommending setting the public hearing and has included in <br />the consent agenda the setting of the public hearing on April 25, 1983 <br />at 7:50 p.m. <br />JCJ/bc <br />1 <br />
