Mounds View Planning Commission i <br />Resolution No. 58-82 <br />Page 2 <br />ATTEST; <br />a. Sixty percent or more of the units, exclusive of any <br />occupied by Lhe caretaker, shall be designated for <br />occupancy by the elderly for a duration of al• least ten <br />years. No amendment to the conditional use permit that <br />changes the designation of these units for occupancy by <br />the elderly shall be made within ten years. Any such <br />amendment after ten years must be adopted by a 4/5 vote <br />of Lhe members of the City Council. <br />b. If required by the City, the owner of the property shall <br />record a covenant on the property executed in a form <br />approved by the City which indicates the fact that the <br />property is designated for occupancy by the elderly. <br />c. The development is assisted by the U.S. Department of <br />Housing and Urban Development under one of its programs <br />for housing low and moderate income elderly or such <br />housing is constructed and/or operated by a profit or a <br />non-profit organization which can demonstrate <br />experience and a commitment to housing for the elderly, <br />and provided such agency shall record at least a 20-year <br />covenant and other land use controls on the property, <br />executed in a form approved by the City, which will limit <br />use of the property or a portion thereof to the occupancy <br />by the elderly under the terms of the provisions governing '- <br />senior citizen housing. <br />d. The development provides for a lounge or other inside <br />common areas amounting to at least 15 square feet for <br />each unit. <br />e. The development is provided with other special features <br />which meet the needs of low and moderate income elderly <br />persons. ' <br />f. T•he site shall be of adequate size to accommodate the <br />required number of parking spaces should the facility <br />convert to other R-4 permitted uses, and will meet the <br />requirements of Section 40.05, "Yard Requirements". <br />Adopted this 4th day of August, 1982. <br />Chairman <br />(SEAL) <br />Public Works/Community Development <br />Director <br />
