g1z,J, K / \ MEMO TO: Mayor and City Council FROM: Engineering/Planning Technician iJ DATE: August 11, 1982 SUBJECT:� DYNAMIC DESIGNISRS Staff received a phone call from Mr. Jim Cepress of Dynamic Designers requesting consideration by the City to construct the two fourplex buildings as was approved by the Council back in 1980. To provide some background information, a development agreement (N80-40) was drafted and resolution passed approving the develop- ment agreement but because of housing marketing conditions/lack of financing, etc., the developer dropped plans for the project and the development agreement was never signed. During the latter stages of the approval process, a certain amount of fill was depos- ited on the lots per the site plan which was approved for the development. The deposition of this fill was unauthorized. but do to the fact that the project was nearing completion and fill would have been required for development of the buildings, the developer was not required to remove the fill at that time. The developer is now requesting the process to continue where it left off back in 1981. I spoke to Dick Meyers regarding this issue and it was his opinion that Mr. Cepress would have to go through the process once again to develop this property. The resolution 0 1373) which rescinded the resolution approving Development Agreement No. 80-40 and also author- ized a refund of the fees paid is attached for your review. Please note the last paragraph of this resolution which states that the City will review any future proposal for the property under existing or future ordinances and resolutions that may pertain when a future application is made. Ordinance No. 301 was not in effect when the proposal was first approved but it is in effect at the present time. The two lots in question lie almost entirely within the area regulated by Ordinance No. 301. Ordinance No.305 gives the City Council the authority to grant a permit for now building developments fcr the dry, buildable portion of parcels affected by the ordinance. A determina- tion may now have to be made if the fill that was deposited on the site has made portions of the site dry, buildable and thus approval could be granted under Ordinance No.,305.
