g1z,J, K <br />/ \ MEMO TO: Mayor and City Council <br />FROM: Engineering/Planning Technician iJ <br />DATE: August 11, 1982 <br />SUBJECT:� DYNAMIC DESIGNISRS <br />Staff received a phone call from Mr. Jim Cepress of Dynamic <br />Designers requesting consideration by the City to construct the <br />two fourplex buildings as was approved by the Council back in 1980. <br />To provide some background information, a development agreement <br />(N80-40) was drafted and resolution passed approving the develop- <br />ment agreement but because of housing marketing conditions/lack of <br />financing, etc., the developer dropped plans for the project and <br />the development agreement was never signed. During the latter <br />stages of the approval process, a certain amount of fill was depos- <br />ited on the lots per the site plan which was approved for the <br />development. The deposition of this fill was unauthorized. but do <br />to the fact that the project was nearing completion and fill would <br />have been required for development of the buildings, the developer <br />was not required to remove the fill at that time. The developer is <br />now requesting the process to continue where it left off back in 1981. <br />I spoke to Dick Meyers regarding this issue and it was his opinion <br />that Mr. Cepress would have to go through the process once again to <br />develop this property. The resolution 0 1373) which rescinded the <br />resolution approving Development Agreement No. 80-40 and also author- <br />ized a refund of the fees paid is attached for your review. Please <br />note the last paragraph of this resolution which states that the City <br />will review any future proposal for the property under existing or <br />future ordinances and resolutions that may pertain when a future <br />application is made. Ordinance No. 301 was not in effect when the <br />proposal was first approved but it is in effect at the present time. <br />The two lots in question lie almost entirely within the area regulated <br />by Ordinance No. 301. Ordinance No.305 gives the City Council the <br />authority to grant a permit for now building developments fcr the dry, <br />buildable portion of parcels affected by the ordinance. A determina- <br />tion may now have to be made if the fill that was deposited on the <br />site has made portions of the site dry, buildable and thus approval <br />could be granted under Ordinance No.,305. <br />Please direct staff what the Council would like done regarding this <br />item and also if any additional information is needed. <br />FJK/bc <br />attachment <br />CC; John C.
