'O'. w /o MEMO TO: Clerk -Administrator and City Council FROM: Building Inspector DATE: August 19, 1982 SUBJECT: '1EMPORARY OCCUPANCY FOR STANDARD U1L BUILDING Attached is a letter from J. E. Duoos Construction regarding a request for occupancy of the Standard Oil Station located at 2155 Highway Avenue. Since the project site is not entirely completed at this point in time, the usual action taken by the City at this time would be to grant a temporary occupancy. Keep in mind that the overall development and completion of the project site is covered by Development Agreement No. 81-51, with a security of $15,000. Since in most cases with commercial, industrial or high density residential development, building completion is often completed prior to all of the site work. Sometimes partial occu- pancy or total occupancy, depending on the size of the building, is requested prior to completion of that overall site such as is being requested by J. E. Duoos. The City's past policy then has been to issue a temporary pending completion of the entire site. At that time, the City Council would authorize a resolution noting completion of the project and release of the agreement security. Staff would then follow up the Council's subsequent action with the issuance of a final occu- pancy permit for the building. You will recall that approximately one month ago you were informed by staff that Tyson Warehouse may be requesting a temporary occu- pancy in which to start their distribution center before total completion of the project site. It was staff's understanding at that point in time that Council had no objection to that and we could proceed issuing the temporary occupancy if it were requested prior to total completion of the project site. Tn HM-A staff has not issued a temporary occupancy, but it may be requested within the next week. Staff has taken the policy of notifying Council prior to the issuance of temporary occupancies so that Council is aware of activities that may be occurring on the project site and also to receiveyour input should you not request or desire to have that temporary occupancy permit granted should certain specific problems exist that staff may not be aware of. The granting of it temporary occupancy generally only applies specifically to the building code as to whether or not the building is safe for the occupancy being requested. It does not, however, extend itself to completion of overall development site in all cases. The issuance of that temporary occupancy does not take any
