'O'. w /o <br />MEMO TO: Clerk -Administrator and City Council <br />FROM: Building Inspector <br />DATE: August 19, 1982 <br />SUBJECT: '1EMPORARY OCCUPANCY FOR STANDARD U1L BUILDING <br />Attached is a letter from J. E. Duoos Construction regarding a <br />request for occupancy of the Standard Oil Station located at <br />2155 Highway Avenue. Since the project site is not entirely <br />completed at this point in time, the usual action taken by the <br />City at this time would be to grant a temporary occupancy. Keep <br />in mind that the overall development and completion of the project <br />site is covered by Development Agreement No. 81-51, with a security <br />of $15,000. Since in most cases with commercial, industrial or <br />high density residential development, building completion is often <br />completed prior to all of the site work. Sometimes partial occu- <br />pancy or total occupancy, depending on the size of the building, <br />is requested prior to completion of that overall site such as is <br />being requested by J. E. Duoos. <br />The City's past policy then has been to issue a temporary pending <br />completion of the entire site. At that time, the City Council <br />would authorize a resolution noting completion of the project and <br />release of the agreement security. Staff would then follow up <br />the Council's subsequent action with the issuance of a final occu- <br />pancy permit for the building. <br />You will recall that approximately one month ago you were informed <br />by staff that Tyson Warehouse may be requesting a temporary occu- <br />pancy in which to start their distribution center before total <br />completion of the project site. It was staff's understanding at <br />that point in time that Council had no objection to that and we <br />could proceed issuing the temporary occupancy if it were requested <br />prior to total completion of the project site. Tn HM-A staff has <br />not issued a temporary occupancy, but it may be requested within <br />the next week. Staff has taken the policy of notifying Council prior <br />to the issuance of temporary occupancies so that Council is aware <br />of activities that may be occurring on the project site and also to <br />receiveyour input should you not request or desire to have that <br />temporary occupancy permit granted should certain specific problems <br />exist that staff may not be aware of. <br />The granting of it temporary occupancy generally only applies <br />specifically to the building code as to whether or not the building <br />is safe for the occupancy being requested. It does not, however, <br />extend itself to completion of overall development site in all <br />cases. The issuance of that temporary occupancy does not take any <br />
