49.07, 3, e <br />granted, shall be deemed a violation of this Chapter <br />punishable under Section 49.09. A copy of all decisions <br />granting Variances shall be forwarded by mail to the Com- <br />missioner of Natural Resources within ten (10) days of <br />such action. <br />(f) Appeal to the City Council and District Court. Appeals <br />from any decision of the Board may be taken by an person <br />or persons, jointly or severally, aggrieved by any decision <br />of the Board, or any taxpayer, officer, department, board, <br />or bureau of the municipality, to the City Council. The <br />decision of the City Council may be appealed to the district <br />court, of this jurisdiction as provided in Minnesota Stat- <br />utes 462.361. <br />Subdivision 4. Conditional Uses. The City Council shall hear <br />and decide applications for conditional uses permissable under this <br />Chapter. Applications shall be filed with the Clerk -Administrator <br />who shall forward the application to the Planning Commission for con- <br />sideration. The Planning Commission shall in turn refer application to <br />the City Council for decision as provided in the Municipal Code. <br />(a) Hearings. Upon referring to the City Council an applica- <br />tion for a Conditional Use Permit, the City Council shall <br />submit by mail to the Commissioner of Natural Resources a <br />copy of the application for proposed Conditional Uses <br />sufficiently in advance so that the Commissioner will <br />receive at least ten (10) days notice of the hearing. <br />rs <br />
