In addition, the monetary value of <br />r� any competitive advantage derived by the operation of such <br />nonconforming use, by ruason of the limitation on establish- <br />ment of competing businesses as a result of this Chapter, <br />shall be considered as a reduction of losses resulting from <br />the requirement of termination of the use under this <br />Chapter. <br />(h) The Zoning Administrator shall prepare a list of those <br />nonconforming uses which have been flood -proofed or other- <br />wise adequately protected in conformity with Section 49.07, <br />Subdivision 4(g) of this Ordinance. He shall present such <br />list to the City Council which may issue a certificate to <br />the owner stating that such uses as a result of these cor- <br />rective measures, are in conformity with the provisions of <br />this Chapter. <br />49.09 PENALTIES FOR VIOLATION. <br />Violation of the provisions of this Chapter or failure to <br />comply with any of its requirements (including violations of conditions <br />and safeguards established in connection with grants of Variances or <br />Conditional Uses) shall constitute a misdemeanor. Any person who <br />violates this Chapter or fails to comply with any of its require- <br />ments shall upon conviction thereof be tined not more that $500 or <br />imprisoned for not more than ninety (90) days, or both, and in addi- <br />tion shall pay all costs and expenses involved in the case. Each day <br />such violation continues shall be considered a separate offense. <br />Nothing herein contained shall prevent the City Council from <br />taking such other lawful action as is necessary to prevent or remedy <br />any violation. <br />,�-3 <br />
