42.10 <br />showing that the necessary arrangements with the utility <br />involved for the installation of said facilities will be <br />OWN made. <br />Subdivision 2. Excc_ptions• The foregoing requirements in <br />Subdivision 1 may be waived by the Council, if after study and <br />reconmendation by the Planning Commission that (1) and/or (2) below <br />are applicable to the proposed subdivision: <br />44 (A) The placing of cletric and telephone utilities under- <br />ground would not be compatible with the development planned. <br />42}(B) Unusual topography, soil, or other physical conditions <br />make underground installation unfeasible from an engineering <br />viewpoint or the cost impractical. <br />42.11 SOIL TESTS. Upon the advice of the City Engineer the <br />Council may require soil tests prior to -the approval of the final <br />plat. Such test holes, when ordered by the City authorities, shall <br />be drilled at the expense of the owner or developer and the infor- <br />mation disclosed shall be furnished to the Council together with a <br />copy of the proposed plat showing the location of each test hole, <br />the information as to the various types of soil encountered and their <br />depths, the level of the ground water and a seepage test and may <br />include additional information. The number of test holes to be <br />drilled and their .location on the property which is proposed to be <br />platted will be as directed by the Council or their authorized rep- <br />resentative. <br />42.12 PUBLIC SITES, PARKS AND PLAYGROUNDS. Where a proposed <br />park, playground, school site or other public site as shown on the <br />Comprehensive Plan or. Open Sapcc Master Plan is embraced in part <br />or in whole by the boundary of a proposed subdivision and such public <br />sites are not dedicated to the Municipality or Board of Education, <br />such public ground shall be reserved and no action taken toward <br />approval of a subdivision for a period not to exceed ninety (90) days <br />to allow the Council to take action toward acquisition of such public <br />ground or park by purchase or other means. <br />42.13 PARKS AND PLAYGROUNDS DEDICATION. <br />Subdivision 1. Dedication Required. <br />41} (A) Pursuant to Minnesota Statutes 462.358, in all subdivi- <br />sions to be developed for residential, commercial, industrial <br />or other uses, or as a planned development which includes <br />residential, commercial and industrial uses, or any combina- <br />tion thereof, a reasonable portion of each proposed subdi- <br />vision shall be dedicated to the _public for public use as <br />parks, playgrounds, public open space, or storm water holding <br />areas or ponds, or, at the option of the Municipality, at its <br />sole discretion, that the subdivider contribute an equivalent <br />amount in cash based on the fair market value of the unde- <br />veloped land. <br />
