PAU L.IA MINI::SDTATA !"Ili <br />7111y 1I, 19N1 <br />Mounds View Planning Commission <br />City of Mounds View <br />2401 highway 10 <br />Mounds View, Minnesota 55112 <br />Re: Condominium Ucvolopment <br />Members of the Commission: <br />�'134g` 0 <br />,Y \� 6 <br />o AU) 19 P. <br />,11 <br />RECEIVED <br />CITY OF <br />\ =;: MOOS VIEW <br />You have recently submitted to this office a request G <br />for information relative to the state condominium laws as <br />they affect the City's subdivision regulations and zoning code. <br />' Chapter 40.02(18) defines condominium as "a multiple <br />dwelling containing individually owned dwelling units and jointly <br />owned and shared areas and facilities, which dwelling is subject <br />to the provisions of the Minnesota Condominium Law." <br />The present Minnesota Statutes relating to condominium <br />development has the following definitions: <br />Condominium means real estate, portions of which <br />are designated for separate ownership and the <br />remainder of which is designated for common <br />ownership solely by the owners of those portions. <br />Real estate is not a condominium unless the in- <br />dividual interests in the cutmnon elements are <br />vested in the unit owners. <br />Real estate means any interest in, over or under <br />land including structures which by law.pass with <br />a conveyance of land. <br />Unit means a portion of the condominium designated <br />for separate ownership. <br />Pursuant to the condominium law each unit constitutes for <br />all purposes a separate ap reel of real estate, <br />
