3 <br />c <br />Subdivision 2. Required Facilities. <br />The City may, at its sole discretion, require storm sewers, <br />retention or detention basins or any other type of drainage improve- <br />ments that are required for any development proposal. <br />Subdivision 3. Performance Guarantee. <br />Whenever privately owned and maintained drainage improvements <br />shall be required for a development by the City, the developer shall <br />provide a seven year maintenance/performance guarantee to assure proper <br />maintenance and operation of such improvements. In such cases, the <br />developer shall also hold the City harmless for any defects in design, <br />construction or operation. <br />Subdivision 4. Pinancial Responsibility. <br />Drainage facility improvements required for any development <br />proposal shall be the financial responsibility of the developer. <br />49A.03 Design Standards. <br />Storm sewer systems required for any development shall be <br />constructed to at least a five year frequency storm design, retention <br />basins shall be constructed to retain at least a hundred year storm <br />while allowing at a maximum, only that rate of runoff from the property <br />in its undeveloped state resulting from a five year storm frequency. <br />49A.04 Definitions. <br />Subdivision 1. Five, Fifty and One Hundred Year Storm. <br />Ti- shall ha as determined by U.S. weather Bureau Technical Paper <br />Nos..40 and 49 and shall be the 24 hour rainfall event with a probabil- <br />ity of reoccurrence of once in five, fifty or one hundred years. <br />Subdivision 2. Retention Basin. <br />It shall be an area designated to store the surface water drainage <br />from the adjoining drainage basin with no outlet to downstream areas. <br />
