i <br />MEMO TO: Mayor and City Council <br />FROM: Clerk-Admini::trato� <br />DATE: January 18, 1983 <br />SUBJECT: GOLDEN GLOVES EXHIBITION BOXING MATCH LICENSE FEE <br />Attached please find a copy of a letter to Mayor McCarty from <br />Mr. Roger Young,of Golden Gloves Minnesota,requesting that he be <br />placed on the Agenda of the Mounds View City Council Meeting on <br />January 24, 1983 to discuss the $100.00 license fee charged by <br />the City for the Golden Gloves Exhibition Boxing Matches held <br />on January 10, 1983 at the Bel -Rae ;allroom. <br />As you may recall, the Council initially addressed the issue of <br />a permit for a Golden Gloves Boxing Natch Exhibition at your <br />meeting on December 27,1983. Your packet for that meeting included <br />an application for the boxing match, a letter from Golden Gloves <br />requesting a waiver of the fee, and a moninrandum from this office <br />indicating that• the fee for a boxing event is $100.00. At the <br />December27th meeting actiun on these license applications was <br />tabled due to some concerns regarding the application for a gamling <br />device license which would have permitted the conduct of a Las Vegas <br />Night event on the same evening as the boxing matches were held. <br />\ At a Special Council Meeting on January 3, 1983, the issue of the <br />gambling device permit for Golden Gloves was again discussed by <br />the Council and a moratorium was placed on the issuance of all <br />future gambling device permits until a report was received from <br />the City Attorney on the issue of licensing of gambling devices. <br />The Council also took action to issue the boxing match permit <br />for the January loth event but did not address the issue of the <br />$100.00 license fee. Therefore, when staff issued the license on <br />January 7th, the $100.00 fee was required as staff did not feel <br />they had any authority to waive the fee at that time. <br />In telephone conversations with Mr. Young, after the license was <br />issued, he was advised that staff did not have the authority to <br />waive the license fee, however, he had every right to present his <br />case to the City Council and request that the license fee be refunded <br />on the basis that the boxing matches were held by a non-prof.i.t <br />corporation. A review of City records does not reveal that a <br />non-profit corporation has held boxing matches in the City of Mounds <br />View at any time in the past and, therefore, no precedent has been <br />set with respect to the refunding of boxing match license fees. <br />Your direction in this matter will be appreciated. <br />DFP/pf <br />Attachment <br />
