MEMO TO: Mayor and City Council <br />FROM: Clerk -Administrator <br />DATE: February 1, 1983 <br />SUBJECT: BINGO AND GAMBLING DEVICE PERMITS <br />Pursuant to your direction, staff requested a report from <br />City Attorney Richard Meyers regarding the referenced subject <br />matter as it relates to statutory requirements in Chapter 107 <br />of the Municipal Code. Attached is a copy of Attorney Meyer's <br />response, as well as a copy of Minnesota Statute 349 relating <br />to bingo and gambling devices, as well as a copy of an informa- <br />tional bulletin from the League of Minnesota Cities relating to <br />the licensing of bingo games and gambling devices. <br />Staff has reviewed the various statutory and municipal code <br />requirements for the issuance and follow-up on bingo and gambling <br />device permits and determined that the following basic activities <br />would need to be performed during the application process or as <br />a follow-up once a permit is issued: <br />A. Application Process <br />1. Verification of application information and conformance <br />with statutory or municipal code requirements. <br />2. Verify membership of individuals who will be operating <br />bingo or gambling devices. <br />3. Verify fidelity bond of bingo or gambling manager unless <br />waived by the City Council. <br />4. For gambling permit only - Verify lease agreement. <br />B. Operation <br />1. Verify that bingo or gambling occasion is being legally <br />conducted by on -site inspection. <br />C. Reports <br />1. For bingo permits - Verify accuracy of statutory <br />required reports and lease (M.S. 349.21, Subd. 3). <br />2. For gambling device permits - Verify accuracy of report <br />on gross receipts, expenses and profits, and the <br />distribution of profits. <br />
