MEMO TO: Mayor and City Council <br />FROM: Clerk -Administrator <br />DATE: January 21, 1983 <br />SUBJECT: LIQUOR LICENSING - FINANCIAL RESPONSIBILITY <br />Attached please find a copy of a letter received by this office <br />from City Attorney Richard Meyers indicating that Minnesota Laws <br />1982, Chapter 528, requires that every person licensed to sell <br />intoxicating liquor or 3.2 beer at on -sale or off -sale demonstrate <br />proof of financial responsibility as of March 1, 1983. Attorney <br />Meyers provides specific recommendations regarding the amendments <br />of Chapters 100 and 101 of the Municipal Code as they relate to <br />the licensing of intoxicating and non -intoxicating liquor sales. <br />Also attached please find Ordinance Nos. 331 and 332 for your <br />review which implement the recommendations of City Attorney Meyers. <br />In conversations with City Attorney Meyers, he advised that this <br />office immediately notify all intoxicating and non -intoxicating <br />license holders that have not provided the City of Mounds view with <br />proof of insurance, bond, or deposit with the State Treasurer as <br />part of the City's licensing requirements and advise them of the <br />requirements of the Minnesota Statute and request that they provide <br />the City with proof of financial responsibility, thus, complying <br />with these requirements no later than the March 1st deadline. A <br />copy of the letter sent to these licensees is attached for your <br />information, along with a listing of those contacted with respect <br />to this matter. City Attorney Meyers has further advised that <br />it is not necessary that the City Council complete the adoption <br />and publication process of these ordinances prior to the March 1st <br />as long as the licensees are required to comply with the require- <br />ments of the State Statute, however, amendments to the City's Codes <br />should be handled in as timely a manner as possible. <br />Unless otherwise directed, it is staff's intention to place these <br />ordinances on the February 19th Agenda for a first reading. <br />UFP/pf <br />Attachments <br />
