-13- <br />A. Mandatory Criteria <br />47. Avoid shorelands, floodplains and protected wetlands was a mandatory <br />factor for chemical treatment, transfer/storage and incineration areas. <br />48. Statutory requirements -- Under Section 115A.09 the Board must consider <br />the consistency of a site with State and Federal regulations. The Pollution <br />Control Agency's (PCA) hazardous waste rules provide that hazardous waste <br />facilities shall not be located in shoreland, floodplains and wetlands. 6 <br />MCAR i 4.9004B.1. In addition, excluding shoreland, floodplains and wetlands <br />provides protection for some natural resources. Protection of natural resources <br />is also a factor which must be considered by the Board under the Waste Management <br />Act. <br />49. A major issue raised at the public meetings was concern for protection of <br />water quality. The prime threat to water quality from a hazardous waste pro- <br />cessing facility is the chance of accidental spills. By locating a facility <br />away from a shoreland and the chance of a spill running into a water body (and <br />adversely affecting water quality) is diminished. <br />50. Area must be planned or zoned for industry was mandatory for chemical <br />treatment and transfer/storage areas. <br />51. Statutory requirements -- Requiring that only land which has been planned or <br />zoned for industry be considered for hazardous waste processing facilities addresses <br />several criteria which the Board must consider. The use of industrial land helps <br />to insure that the facility will be consistent with local land use and land use <br />controls, and will be consistent with existing and future development patterns. <br />Giving preference to industrial areas help to ensure that the services appropriate <br />to a hazardous waste facility will be available and that the processing facilities <br />
