\ MEMO TO: Mayor and City Council <br />FROM: Director of Public Works/Community Development <br />DATE: March 24, 1983 <br />UBJBCT: WETLAND ALTERATION PERMIT FOR LOTS 1 AND 2, BLOCK 2, <br />PARK VIEW TERRACE, FOR TONY POPPELAARS <br />Mr. Dick Meyers, Don Pauley, and myself met on March 23, 1983 to <br />discuss questions raised at the joint City Council and Planning <br />Commission meeting held March 21, 1983. Mr. Meyers will meet with <br />the Council at 6:30 p.m. on March 28, 1983 to answer any further <br />questions. <br />The following facts were identified by staff which the Council should <br />use in making their decision on the application: <br />1) Per provisions of 48.05, Subdivision 6, both lots 1 and 2 <br />are non -conforming and will need variances per provisions <br />of Chapter 40 (decision by the Planning Commission) in <br />order to develop. <br />2) Lot 1 does not contain any "wetland" but is almost entirely <br />covered by the wetland buffer area. To build on Lot 1, a <br />variance to the 100 foot setback provision of 48.05, Subdivi- <br />sion 5, will be necessary together with the alteration permit. <br />3) Lot 1 has 14,380 square feet and at a density of one unit per <br />2,500 square feet would allow 5.75 units if parking and open <br />space requirements are met. <br />4) Lot 2 has 1G,799 square feet of which 9,500 square feet are <br />wetland. Only accessory buildings which do not conflict with <br />purposes of Chapter 48 can be allowed within a wetland per <br />provisions of 48.05, Subdivision 2. <br />5) If lots 1 and 2 are combined into one parcel of record (which <br />would require a replat), then the density transfer provisions <br />of 48.08, Subdivision l(B) could be utilized. Total developable <br />area is 21,679 square feet which would allow 8.67 units plus <br />transfer of up to 7.6 units from the wetland for at total maxi- <br />mum density 551­16.27 units if parking and open space requirements <br />can be met, if any. <br />6) Precedent, if any, set would only apply to drainage basin of <br />wetland in question. <br />7) Use of the property in question has been determined by current <br />zoning (R-3), Comprehensive Plan, public improvements of sewer, <br />water and street, special assessments and previously paid <br />property taxes. <br />
