MEMO TO: Clerk -Administrator and (:Ity con tit: fl <br />FROM: Engineering/Planning Technician <br />DATE: August 17. 1983 <br />SUBJECT; BAYERROIILER UEH LOPMENT <br />The Planning Commission at their August 3, 1983 regular meeting <br />reviewed a request by Mr. Gordon Bayerkohler to rezone the <br />existing 4-unit residential building at the corner of Sunnyside <br />Road and lilghway 10 from R-3 to II-2. The planning Commission <br />recommended approval by adopting Resolution No. 91-83 (copy <br />attached). Also attached are the following items relating to <br />this proposal: <br />I) Staff report <br />2) Staff memorandum dated July 22, 1983 <br />3) Letter from Mr. Bayerkohler <br />4) Planning Commission minutes of August 3, 1983 <br />(unapproved) <br />5) Site plan <br />Staff has prepared Resolution No. 1643 approving the Planning <br />Case and Ordinance No. 346 for your review. A final landscape <br />plan was not available for inclusion with this packet but will be <br />available from the applicant at the meeting. <br />To date, staff has not received a permit from Rice Creek <br />Watershed District approving this proposal. The developer missed <br />the August 12th deadline to submit materials for District Board <br />approval on August 24th. The next board meeting where approval <br />could be granted would be September 28th since they only meet <br />once a month. <br />The developer is asking that the City Council approve their <br />proposal at this time contingent upon approval by the Rice Creek <br />ff <br />at the <br />oftevents taker place ifathe rCouncil dhas hno concerns regarding sequencewing <br />regardingthe <br />proposed rezoning request. <br />1) August 22 - Council approves the development request <br />(Resolution No. 1643) and conducts a first reading <br />u on an ordinance to rezone (ordinance No. 346). <br />ed <br />til <br />ty staff <br />eceives <br />2) The second notification efrom gstaff is eofyRice nCreek iWatershed rDistrict <br />that approval by the District Board will begive. Should <br />the Council elect to wait for their approval <br />until <br />approval from the Rice Creek Board is given on September <br />28th, construction would not be able to start until the <br />the end of November which is too late <br />in the <br />hhseason to <br />start construction on the parking, g and <br />storage area proposed. <br />
