CASE: 131-83 <br />ITEM: Rezoning (It-T to 5-2) <br />Variance (Side dP Setback) <br />(Reduced I'arkinl; Sparc::) <br />APPLICANT: Cordon 9nyerknh1rr <br />LOCATION: UnL Suuuyside Road <br />SUMMARY 06 RP.OURST <br />See attached letter which describes this revised request. The <br />previous; request proposed to rezone the property to an R-0, <br />Residential OfIlea nLStrIct, which would have required both a <br />side yard setback variance and conditional use permit approval. <br />The applicant has since withdrawn this previous request. <br />PLANNING CONSIDERATIONS <br />1. Existing zoning on the property is R-3, Medium Density <br />Residential. <br />2. Comprehensive Plan denotes the area as being Nigh Density <br />Residential. <br />3. The applic4-nt unit is <br />requesting a itresidential building nentirely to annofficevert 11e <br />existingting <br />building. <br />4. Setbacks: <br />a) Front and rear setbacks have been met. <br />b) The existing building is located [en feet from the cast <br />property line. Setback requirements for R-3 (the present <br />use and zoning of the building)is 20 feet when it abuts <br />another residential lot. The setback requirement for B-2 <br />buildings (proposed use) is also 20 feet when it abuts a <br />residential lot. The existing setback for both the <br />present use (R-3) and proposed use (8-2) does not meet <br />Code requirements. By changing the zoning and use of the <br />existing structure, a continuance of the non -conforming <br />setback is being requested. This would require a variance <br />to continue the non -conformity. It should be noted that <br />the variance request is not as a result of an action by <br />the applicant. A non -conformity exists whether the <br />building remains as an R-3 or whether it is converted to <br />offices (B-2). <br />5. There are no minimum lot width and area requirements for B-2 <br />uses. <br />n 6. Parking - The site plan shows 18 parking spaces, whereas, the <br />Zoning Code requires 20 spaces. A variance of 2 parking <br />spaces is required. Spaces shown measure 9-1/2 x 20 feet, <br />meeting existing Code requirements. <br />
