Pursuant to Ilimm. stet. 4 115A.09 (1982), this hearing -a neither a <br />rvfemakirg proceeding nor a contested case proceeding. The hearing was Cm- <br />ducted so as to afford all interested persons an opportunity to ask questions, <br />testify and present evidence on the subject matter. <br />2. The Minncsaa Pollution Control Igeny fulfilled its statutory obliga- <br />tions by preparing a suitability report on the proposed area. <br />3. The Minnesota Paste Management Board has complied with all substantive <br />and procedural requirements of law. The Board and the Hearing Dwiner have <br />jurisdiction in this matter. <br />4. Any of the foregoing findings which should more properly be deemd <br />Conclusions arc hereby ,.C.cR td as such. <br />aa. s.d upon the foregoing Conclusions, the Hearing Dcaminer makes the fol- <br />lawing: <br />:OgIw1AN_ �a <br />'hat the Minnesota Vbste Management Board, whan it considers which pro- <br />posed areas to be, included in the final inventory of preferred areas, give <br />special consideration to the following items: <br />a. The naturally high water table and the rapid permeability rate of <br />is <br />the soils in the proposed area: <br />b. The storm sewer drainage system which discharges storm runoff <br />into the surface water stream that discharge into the Mississippi River; <br />c. The existence of municipal water intakes on the Mississippi River; <br />d. Municipal well development directly adjacent to the proposed area; <br />e. The accident rate of the transportation access to the Proposed <br />area: <br />f. The proximity of the proposed site to residential development; <br />g. The absence of a natural aquiclude to protect a significant sur- <br />ficial aquifer locata'1'Irthe proposed area; <br />h. The proximity of city parks and recreation areas within and im- <br />mediately adjacent to the proposed arelif <br />1. The lack of seder service in a small portion in the nui Lit of t -- <br />proposed area; and <br />J.
