I4EMO TO: <br />Mayor and City Council <br />Clerk -Administrator <br />FROM: Engineering/Planning Technician <br />DATE: September 30, 1983 <br />SUBJECT: BAYERKOHLER REZONING <br />At the August 22, 1983 Council meeting, the first reading to rezone <br />the existing 4-unit residential building located at 7901 Sunnyside <br />to R-2 was conducted L motion .,a- madc for staff tit delay submitting <br />the ordinance for second reading until proof of title transfer and <br />approval from the Rice Creek Watershed District has been received. <br />Staff has received an executed contract for deed agreement signed by <br />the present fee owners of the property and future owners and has <br />also received a verbal response from the Rice Creek Watershed District <br />that approval was given at their September 28th meeting. The contract <br />for deed agreement, according to City Attorney Meyers,is sufficient <br />as proof of title transfer. <br />Attached are the following for action at your October 10, 1983 meeting: <br />1) Ordinance No. 346 for second reading. <br />2) Resolution No. 1664 authorizing execution of Development <br />Agreement No. 83-62. <br />3) Appropriate pages of Development Agreement No. 83-62. <br />STAFF RECOMMENDATION: Approve Resolution No. 1664 and to have the <br />second reading of Ordinance No. 346. <br />FJK/pf <br />Attachments <br />
