i <br />MEMO TO: Mayor and City Council <br />FROM: Clerk -Administrator <br />DATE: October 26, 1983 <br />SUBJECT: CABLE TV LEGISLATION <br />Attached to this memorandum please find a bulletin from the League <br />of Minnesota Cities regarding the Cable Telecommunications Act of <br />1983. It is pointed out in this memorandum that this legislation <br />would be damaging to cable communications franchising and is contrary <br />to League policy for the following reasons: <br />1. The Act prohibits local governments from regulating cable tele- <br />vision rates. <br />2. Presumption that franchise will be renewed with existing company. <br />3. Abrogation of contract provisions covering facilities, equipment, <br />and cable services. <br />4. No grandfather clause for existing franchise. <br />As it has been the past practice of the City Council on issues of this <br />nature to request that the North Suburban Cable Commission, on behalf <br />of the City of Mounds View and the nine other member municipalities, <br />to take a formal stance on the issue and advise our Federal legislators <br />of such a position, staff would recommend that we do the same in this <br />case. <br />DFP/pf <br />Attachment <br />
