The sending municipality shall be responsible for Its own <br />personnel, equipment, ar.d supplies, and the receiving muni- <br />cfpaliLy shall not be held llnble for any injuries to personne)--, <br />or damage to equipment of the sending municipality, nor shall <br />the receiving municipnlil}' be required to reimburse the sendin,, <br />man icIpit lfty for supplies used or the cost of personnel and <br />equipmenL while'so engaged, except that any monies received by <br />the receiving municipality from other nonparticipating agen- <br />cies to reimburse the cost of such personnel, equipment, and <br />supplies shall be remitted to the sending municipality in an <br />amount equivalent to the pe.rrrntagn of total cost reflected by <br />the monies received, along with any equipment and supplies <br />unused upon the termtnation of the emergency. <br />Supplies furnished or drawn from pool sources shall he replaced <br />or reimbursed for by the receiving municipality. <br />6. The sending municipality shall not be responsible for any <br />Injuries, losses, or damage to persons or property arising out <br />of the act of any of the personnel of the sending or receiving <br />municipalities. <br />1. In case weather, road conditions, or other circumstances are <br />such that, in the discretion of the Civil Defense/Emergency <br />Services Director of the sending municipality, or his designee, <br />equipment, personnel, and supplies cannot be furnished to the <br />receiving municipality with reasonable safety he may, in his <br />discretion, refuse to authorize and direct assistance to the <br />receiving municipality. The determination of the Civil I <br />Defense/Emergency Services Director of the sending munici- <br />pality, or his designee, as to what assistance as provided <br />herein shall be sent to the receiving municipality, shall be <br />final and conclusive, and shall give rise to no liability on <br />the part of the sending municipality for failure to furnish <br />such assistance. <br />This agreement shall be effective only during periods when a Civil <br />Defense emergency is in effect and duly declared pursuant to local ordi- <br />nance., state or federal law. <br />This agreement may be executed in several counterparts and also <br />executed shall constitute one (1) agreement, binding on all of the parties <br />hereto notwithstanding that all of the parties are not signatory to the <br />original of the same counterpart. <br />This agreement shall be effective after its approval and execution <br />by the parties endorsing this agreement and shall continue in effect <br />thereafter until and unless it is amended by the parties to this agreement <br />or cancelled by any party upon written notice to all other parties. <br />IN WITNESS WHEREOF, the said municipalities have crused this agree- <br />ment to be signed in their respective corporate names by the respective <br />duly authorized officers by authority of their respective governing bodies <br />as of this day of lq <br />Mayor Clerk -Administrator <br />Mounds View Mounds View <br />
