MEMO TO: Mayor and City Council ' <br />( FROM: Clerk -Administrator <br />DATE: December 8, 1983 V <br />SUBJECT: 1983-84 CONTRIBUTIONS TO THE NORTH SUBURBAN CABLE <br />COMMUNICATIONS COMMTSSION <br />At the Agenda Session on December 5, 1983 you received copies of <br />correspondence from Roger Franke, Cable Administrator for the <br />North Suburban Cable Communications Commission, outlining the <br />Commission's response to our concerns that the contributions made <br />by the City of Mounds View to the Commission will be reimbursed <br />through franchise fees or other means. <br />Mr. Franke's letter outlines several clauses in the franchise <br />which provide guarantees by which Group W accepts responsibility <br />for costs incurred by the municipalities for the oversight of the <br />franchise. Also included with this letter is a copy of a communi- <br />cation between the North Suburban Cable Communications Commission <br />and Group W requesting reimbursement of 1983 contributions made <br />by six of the ten member municipalities pursuant to provisions of <br />the franchise agreement. staff feels that after reviewing this <br />information and discussing the matter with our Cable Commission <br />representative, Jerry Skelly, the Attorney for the Cable Commission, <br />and Mr. Franke that the City can be assured that our interests will <br />be and are being protected by the Cable Commission and that appro- <br />priate guarantees are provided to protect us from loses. <br />It should also bu poinLed out that should we not contri.buLe to the <br />operations of the Cable Commission per our agreement with them we <br />will no longer be a voting member of the Commission and become <br />subject to administering the Mounds View portion of the Cable TV <br />Franchise on our own. As you are aware, at the present time, the <br />Cable Commission anti Group W have ontered into some very signi- <br />ficant discussions regarding the provisions of the franchise and <br />the construction of the system. It is the opinion of this staff <br />member that Mounds View is ill prepared to enforce the provisions <br />of the franchise against a major national corporation having unlimited <br />resources and our interests are better protected by maintaining <br />alliance with the nine other municipalities belonging to the Conunissiou <br />where numbers can be to our benefit. <br />RECOMMENDATION: Staff recommends Council authorize payment of the <br />1983 and 1984 contributions to the North Suburban Cable Communications <br />Commission per the attached Resolution No..1678. <br />DFP/pf <br />Attachment <br />
