•ua <br />MEMO TO: Clerk -Administrator and City Council <br />FROM: Director of Public Works/Community Development <br />DATE: December 22, 1983 <br />SUBJECT: CHAPTER 40 (ZONING CODE) <br />At the Joint City Council/Planning Commission meeting on <br />December 21, 1983, the Council advised staff to schedule the <br />second reading of the ordinance adopting a new Chapter 40 on <br />December 27, 1983. A number of items were discussed and follow- <br />ing is a listing of these items and the proposed revisions which <br />should be included in the second reading: <br />P. 20 - 40.04, Subdivision D(2). Add the following at the <br />end of the paragraph: <br />but in no event shall a conditional use permit <br />be grantedfor a solar energy system or structure whit <br />when installed, would prevent abutting properties from <br />being developed in conformance with all applicable cod <br />or regulations. <br />P. 25 - 40.04, Subdivision N(2)d. Delete the entire <br />sentence referring to IODb noise exception. <br />P. 53 - 40.12, Subdivision D(2). This sentence should read <br />as follows: <br />Townhouses up to six (6) units as regulated herein. <br />P. 54 - Insert a new 40.14, Subdivision D(4) which reads as <br />follows: <br />Townhouses as regulated herein. <br />Following second reading, staff will prepare the final copy (minus <br />cross -outs and underlines) for publication in the January 12, <br />1984 New Brighton Bulletin.. Should the second reading occur on <br />December 27 and publication as indicated above, the Zoning Code <br />would become effective on February 11. <br />Staff requests that if the Council is aware of any mirror or <br />cosmetic corrections which may have been overlooked, that the <br />corrections be submitted by January 4, 1984 to allow inclusion in <br />published text (publication deadline is January 6, 1983). <br />/bc <br />
