STAFF REPORT <br />CASE: 145-83 <br />PAGE 2 OF 4 <br />Note: Staff has requested that the IppliC,ant submit, as part Of <br />this application, a traffic study noting the impact of the proposed <br />development on traffic in the general area. The traffic study has <br />not been completed in time for review at the November. 16th meeting. <br />The purpose of the placement of this item on the November 16, 1983, <br />agenda is to inform the Planning Commission of this application and <br />to receive initial input into this proposal. A preliminary traffic <br />study should be available for discussion at the workshop meeting on <br />November 16th. The final traffic study is scheduled to be submitted <br />in time to continue discussion at your regular meeting in December <br />at which time a recommendation could he given or delayed depending <br />upon the status of the review process. <br />PLANNING CONSIDERATIONS <br />1. The existing zoning of the proprer.ty is I-1, Industrial. The <br />property may be officially rezoned to B-2 as part of the <br />Comprehensive rezoning currently underway by the time review of <br />this application is at the official rezoning stage. The <br />rezoning being requested at the present time is I-1 to B-3. <br />This may change from (I-1 to B-3) to (B-2 to B-3) at such time <br />as the Comprehensive rezoning is completed. The Council has <br />approved a rezoning to B-2, but an ordinance to rezone has not <br />officially been drafted and approved. • <br />MINOR SUBDIVISION <br />1. A minor subdivision of one lot into 2 is being requested for <br />this development. Existina Code does not list minimums for lot <br />sizes or frontages for commercial property, therefore, the two <br />lots are in conformance with Zoning Code requirements. <br />To provide better access to the property (access/traffic will be <br />covered when the traffic study is made available), staff <br />questioned the location of the proposed subdivision line. At <br />present, the only useable access to the property is from County <br />Road I. A repositioning of the subdivision line out to Mounds <br />View Drive thereby providing access to and from this development <br />site would have been preferable and still should be pursued. <br />The property seller, Kraus -Anderson, was not receptive to <br />selling additional property to Burger King to allow access out <br />to Mounds View Drive. <br />CONDITIONAL USE PERMIT <br />1. A convenience food establishment is a permitted use in a B-3, <br />Highway Business District by conditional use permit. All items • <br />listed under Section 40.17, Subdivision D(1) seem to have been <br />met with the exception of item F.
