RESOLUTION NO. 1705 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT TO THE. BURGER <br />KING CORPORATION FOR A CONVENIENCE FOOD ESTABLISHMENT <br />WHEREAS, the Burger King Corporation has applied to the <br />City for approval to construct a convenience food establishment on <br />Parcel "A" of Lot 1, Block 10, Silver Lake Woods; and <br />WHEREAS, the City Council is presently in the process of <br />officially rezoning Parcel "A" of Lot 1, Block 10, Silver Lake <br />Woods from its existing 1-1 zone to a B-3 zone; and <br />WHEREAS, the construction of a convenience food establish- <br />ment requires a conditional use permit in a B-3 zoning district; <br />and <br />WHEREAS, the Planning Commission has reviewed this <br />conditional use permit request and has recommended approval by <br />adopting Resolution No. 100-83, noting that all conditions listed <br />under Chapter 40.17, Subdivision D(1) have been met; and <br />WHEREAS, the City Council has reviewed this conditional use <br />permit request and concurs with the Planning Commission's recom- <br />mendation; <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View City <br />Council approves a conditional use permit for the Burger King <br />Corporation for the construction of a convenience food establish- <br />ment on Parcel A of Lot 1, Block 10, Silver Lake Woods provided <br />that: <br />1. Upon initial construction, a curb cut approximately 240 <br />feet from the intersection of County Road I and Highway <br />10 shall be used for all ingress and egress traffic for <br />the Burger King facility. <br />2. At such time as improvements to County Road I, <br />including center median, are completed, a second curb <br />may be constructed between the initially constructed <br />curb cut and the intersection of County Road I and <br />Highway 10, as shown on the attached site plan. <br />3. During the one (1) year period following construction <br />of the second curb cut, should a traffic problem, as <br />determined by the City, arise as a result of this <br />second curb cut, this second curb cut will be closed <br />and the area finished similar to the adjacent areas <br />(landscaping, County Road I improvements, etc.). <br />
