JOINT AND COOPERATIVE AGREEMENT <br />/ ESTABLISHING A 14UNICIPAL LEGISLATIVE CO141ISSION <br />PRELIMINrARY STATEMEW <br />The Parties to this Agreement are governmental units of the <br />State of Minnesota. Minnesota Statute 471.59 permits two or more <br />sub -units, by agreement of their governing bodies, to jointly and <br />cooperatively exercise any power common to each of them. Pursu- <br />ant to statutory authorization, the Parties to this Agreement <br />have chosen to execute a joint powers agreement providing, in <br />essence, for the development of legislative programs on matters <br />of mutual concern and interest. <br />1. UENIiRAL PURPOSE <br />The primary purpose of this Agreement is for the member muni- <br />cipalities to jointly and cooperatively develop legislative pro- <br />grams on matters of mutual concern and interest, and identify, review, <br />and to actively oppose proposals which may be in conflict with <br />the interests of the member municipalities. <br />The organization formed pursuant to this Agreement will be <br />funded by member municipalities' contributions, as herein speci- <br />fied, with contributions being used for the retention of profes- <br />sional assistance, information preparation and dissemination, re- <br />search and other activities that may from time to time be author- <br />ized by the membership. <br />II. NAME <br />The Parties hereto agree to establish an organization to be <br />known as the Municipal Legislative Commission to carry out the <br />objective of this Agreement. <br />III. DEFINITION OF TERMS <br />Section I. Definitions. For the purpose of this Agreement, <br />the terms defined in this'Article shall have the meanings given <br />them by this Article. <br />Section 2. "Board" or "Board of Directors" means the govern- <br />ing body of the Commission. <br />Section 3. "Commission" means the organization created pur- <br />suant to this Agreement. <br />Section 4. "Council" means the governing body of a Member. <br />Section 5. "Directors" means the persons appointed pursuant <br />to this agreement to serve on the Board of Directors. <br />- 1 - <br />
