RESOLUTION NO. 1653 <br />Page Two rI <br />Will',HEAS, the <br />No. 93-113 approvinit <br />I'lannlog Commission has <br />the four IlsLmi <br />adopted Resolution <br />. <br />variances <br />above in Item 5; <br />and <br />WIIEIUAS, the <br />Plannlog Commisslon Ilan <br />also adopted <br />re noIII [Ion No. 94-11'1 <br />rernnimendiIII; approval, <br />with conditions, of <br />Items 1, 2, 3 and 4 <br />listed above; <br />NOW, I'll EItF.FORI', <br />RE IT RESOLVED that <br />the Hounds View City <br />Council grants Lite wetland alteration w1Lh <br />the following <br />condlLionu; <br />1) Conveyance of all easement over the area within the <br />903 contour for drainage purposes. <br />2) Discharge criteria as outlined in 48.06, Subdivision <br />3(c) paragraphs 3, 4, 5 and 6. <br />3) A time limit be act for the completion of the project, <br />in no event to exceed 12 months from the date of <br />issuance of the permit. <br />4) Temporary site disruption shall be allowed to occur <br />generally within the area 15 feet beyond the building <br />edge (as shown on revised site plan dated 8/16/83) <br />provided that these areas be restored to the existing <br />or bettor condition immediately following the time <br />where the use of this area is necessary for buiding <br />construction. <br />5) A density credit of 4.35 units be granted for the <br />development. <br />6) The covenants for the property owners association <br />shall clearly set out the amount and type of use and <br />maintenance that will be allowed within the wetland <br />(below the 903 contour). <br />(Please address and add any other <br />conditions the Council may feel <br />necessary. See staff memo.) <br />BE IT FURTHER RESOLVED that the City Council approves the <br />minor subdivision, the conditional use permit and authorizes the <br />Mayor and Clerk —Administrator to execute Developoment Agreement <br />No. 80-40 with Dynamic Designers for the conetruction of an eight <br />unit condominium. The following items shall be incorporated into <br />Exhibit 2A of the development agreement. <br />;) Performance and maintenance of all drainage structures <br />to be the owner's responsibility. <br />r <br />2) Plan shall show location of emegency overflow for <br />parking area. <br />
