MEMO TO: Director of Public <br />Clerk -Administrator <br />City Council <br />FROM: Building Inspector <br />DATE: May 17, 1984 <br />Works/Community Development <br />SUBJECT: DAILEY HOMES REQUEST - PLANNING CASE 111-82 <br />Attached is a letter of request from Howard Thorson of Dailey Homes. <br />Also attached are copies of City Council minutes dated June 28, 1982 <br />and Planning Commission Resolution No. 55-82 regarding the planning <br />case. Also attached are copies of the wetland and flood plain section <br />maps of the property involved. <br />History <br />During the Spring of 1982 Mr. Thorson of Dailey Homes requested a <br />major subdivision (3 lots into 3 lots) and a rezoning of R-1 to R-2 <br />for property located along the west side of Silver Lake Road. His <br />intensions'were to construct 3 two-family dwelling on the property. <br />He developed plans to extend public improvements to the lots as well <br />as providing the ponding necessary to meet requirements of Resolution <br />No. 983 now known as Chapter 49A. The Planning Commission reviewed <br />the proposal and recommended approval in Resolution No. 55-82. The <br />City Council reviewed that recommendation and conducted a public <br />hearing for the rezoning and subdivision in which they passed a motion <br />approving the Planning Commission action. <br />Today <br />Since the review and approvals were given in 1982 the City has adopted <br />several ordinances that affect the property requested for the devel- <br />opment. They are namely the Wetland Ordinance and Flood Plain <br />Ordinance. As you will note from review of the maps attached, the <br />proposal does fringe on the wetland buffer area. Secondly, the <br />drainage is directed and ponded in the wetland buffer/flood plain area <br />by use of a dike system with a pipe outlet. Easements are proposed <br />for the wetland and flood plain areas. <br />Action Necessary <br />If the City were to consider approval of the 1982 proposal, the <br />following items would neet to be considered: <br />1. Wetland Chapter 48.07, Exceptions; Permits. Is this proposal a <br />prior agreement? <br />
