MEMO TO: Director of Public Clerk -Administrator City Council FROM: Building Inspector DATE: May 17, 1984 Works/Community Development SUBJECT: DAILEY HOMES REQUEST - PLANNING CASE 111-82 Attached is a letter of request from Howard Thorson of Dailey Homes. Also attached are copies of City Council minutes dated June 28, 1982 and Planning Commission Resolution No. 55-82 regarding the planning case. Also attached are copies of the wetland and flood plain section maps of the property involved. History During the Spring of 1982 Mr. Thorson of Dailey Homes requested a major subdivision (3 lots into 3 lots) and a rezoning of R-1 to R-2 for property located along the west side of Silver Lake Road. His intensions'were to construct 3 two-family dwelling on the property. He developed plans to extend public improvements to the lots as well as providing the ponding necessary to meet requirements of Resolution No. 983 now known as Chapter 49A. The Planning Commission reviewed the proposal and recommended approval in Resolution No. 55-82. The City Council reviewed that recommendation and conducted a public hearing for the rezoning and subdivision in which they passed a motion approving the Planning Commission action. Today Since the review and approvals were given in 1982 the City has adopted several ordinances that affect the property requested for the devel- opment. They are namely the Wetland Ordinance and Flood Plain Ordinance. As you will note from review of the maps attached, the proposal does fringe on the wetland buffer area. Secondly, the drainage is directed and ponded in the wetland buffer/flood plain area by use of a dike system with a pipe outlet. Easements are proposed for the wetland and flood plain areas. Action Necessary If the City were to consider approval of the 1982 proposal, the following items would neet to be considered: 1. Wetland Chapter 48.07, Exceptions; Permits.
