r <br />r.� <br />7'So <br />MEMO TO: Steve Thatcher & City Council <br />FROM: Building Inspector <br />DATE: July 5, 1984 <br />SUBJECT: Red Oak Estates #3 <br />Just a brief note and clarification about the history of the Red <br />Oak Estates #3 Plat and the townhome development. <br />History <br />The Red Oak Estates #3 Plat was approved by the City Council on <br />7-8-74. The approval however only allowed the construction of the <br />first six units and remainder of the permits would not be issued <br />until the drainage facilities and ditch were improved. The <br />facilities and ditch were never improved by the developer. Lastly <br />only the first six units were allowed to be built. It is unclear <br />at this time based on the information I have found whether not the <br />drainage improvements were actually made and that the Conditional <br />Use Permit was granted for the remaining 66 units. <br />Legal Action was taken against the City in 74-75 from residents <br />regarding the City's action of allowing the townhomes. The court <br />upheld the City's zoning action of allowing the townhomes to be <br />constructed. <br />Today <br />Existing code today allows townhomes in R-3 Zoned district with <br />a Conditional Use Permit. Lastly attached is a copy of the wetland <br />and flood plain maps for the area. <br />SR/mb <br />
