'���ryitJ <br />MEMO TO: MAYOR AND CITY COUNC L <br />FROM: CLERK-ADMINISTRAT <br />DATE: JULY 12, 1984 <br />SUBJECT: PROPOSED AMENDMENTS TO MUNICIPAL CODE CHAPTER 48 <br />ENTITLED WETLANDS ZONING ORDINANCE AND RESOLUTION <br />NO. 1434 ESTABLISHING POLICY GUIDELINES FOR TAX <br />INCREMENT FINANCING <br />Pursuant to Council direction after a recent presentation by <br />representatives of the Millers, staff has reviewed Chapter 48 <br />of the Municipal Code establishing a Wetlands zoning Ordinance, <br />Resolution Number 1125 setting guidelines for the issuance of <br />tax exempt industrial development bonds or loans by the City <br />and Resolution Number 1,434 establishing policy guidelines for <br />tax increment financing, copies attached. As was mentioned by <br />City Attorney Meyers at your June 18 Agenda Session he has <br />prepared a proposed amendment to Chapter 48.07, C. to delete <br />the current language and replace it with the following language. <br />C. Agreements. Notwithstanding any other provision <br />of this code to the contrary, the City and an <br />owner applicant of lands abutting lands owned by <br />the City may by written contract permit the <br />development of wetlands as part of an integrated <br />plan, involving 40 acres or more, wherein the City <br />would participate in the development of the total <br />parcel, and where the development would reasonably <br />conserve and preserve andwould enhance the environ- <br />ment by providing facilities that would protect the <br />public health, safety, and welfare. <br />During the June 18 meeting discussion occured regarding what other <br />parcels of undeveloped land in the City might benefit from the <br />proposed amendment as outlined by City Attorney Meyers. A review <br />of undeveloped land in the City of Mounds View abutting City parks <br />or other City land reveals that there are 6 parcels that could <br />possibly comply with this provision except for the fact that all <br />are ,mailer than 40 acres in size. These parcels are identified <br />on the attached map with acreage listed. Of these 6, four are <br />impacted in one way or another by the wetlands ordinance and could <br />only develop wholely or partially by being able to comply with this <br />exception provision. <br />A review of Resolution Number 1125 which establishes guidelines for <br />the issuance of tax exempt industrial bonds by the City has resulted <br />in the conclusion that no provisions of this resolution would <br />currently be prohibitive towards industrial or commercial development <br />in the City with the following exceptions: <br />
