MEMO TO: MAYOR AND CITY COUNCIL <br />FROM: CLERK -ADMINISTRATOR <br />DATE: FEBRUARY 8, 1985 <br />SUBJECT: STATE GAMBLING LEGISLATION <br />Attached to this memorandum please find a memo I provided to <br />the Mayor and City Council on August 1, 1984 regarding the <br />referenced subject matter indicating that on February 28, <br />1985 the State Charitable Gambling Control Board will take <br />over the control of the licensing of gambling within the <br />State except when municipalities have adopted more <br />restrictive legislation. Action was not taken on this item <br />at that time due to the concern of the Council regarding the <br />adoption of an ordinance in advance of the effective date of <br />the Law. <br />Staff has reviewed the matter for a second time and <br />determined that we wish to abide by our recommendation <br />contained in the August 1 memo with the addition of the <br />following. It is our understanding the State will be <br />requiring that local jurisdictions sign off on applications <br />indicating their approval of the issuance of a license by <br />the State should the State determine that a license is <br />proper or the local units disapproval of the application <br />which the State will honor. <br />Based on recent correspondence from the League of Cities, <br />copy attached, the Council must adopt a resolution <br />recommending denial of an application. <br />It is Staff's recommendatiun that the Police Chief be given <br />the authority tc review applications and determine whether <br />or not the applicant is acceptable. If the Chief determines <br />that it is his desire that the application be denied, the <br />policy would be that he would submit his recommendation to <br />the City Council at their next meeting for Council <br />concurrence by resolution with this recommendation. <br />RECOMMENDATION: Staff would recommend Council adopt an <br />ordinance rescinding Chapter 107 of the Municipal Code and <br />authorize the Chief of Police to review and comment on <br />applications for State Gambling Licenses with the require- <br />ment that the Chief make recommendation to the City Council <br />for rejection of any applications. <br />DFP/mjs <br />Attachment: <br />
