MEMO TO: Clerk -Administrator and City Council <br />FROM: Director of Public Works/Community Development <br />10�N DATE: April 30, 1985 <br />SUBJECT: MUNICIPAL CODE REVIEW - CHAPTERS 70, 71, 75 AND 76 <br />The names Of the Chapters of the Municipal Code that I will <br />review in this memo are as follows: <br />1) Chapter 70, Municipal Water System <br />2) Chapter 71, Municipal Sanitary Sower System <br />3) Chapter 75, Gas Franchise <br />4) Chapter 76, Electric. Franchise <br />CHAPTER 75, GAS FRANCHISE <br />Chapter 75, Gas Franchise, grants Northern States Power Company <br />permission to conduct, operate, repair and maintain in the City a <br />system of mains, pipelines and other facilities for the manufac- <br />turing, distribution and sale of gas. <br />The City has granted this franchise to N.S.P. until May 1, 1998. <br />Therefore, we cannot change the franchise at the present time. <br />CHAPTER 76, ELECTRIC FRANCHISE <br />Chapter 76, Electric Franchise, grants to N.S.P. permission to <br />conduct, operate, repair and maintain in the City an electric <br />distribution system and transmission lines, including necessary <br />poles, pole lines, fixtures and appurtenances for the furnishing <br />of electric energy to the City and its inhabitants. <br />The City has granted this franchise to N.S.P. until May 1, 1998. <br />Therefore, we cannot change the franchise at the present time. <br />CHAPTER 70, MUNICIPAL WATER SYSTEM <br />There are four changes in this code that I would like to make and <br />one change in the operating procedures of the Water Department <br />that I would like to make. I will discuss the rode changes <br />first, and they are as follows: <br />1) Chapter 70.02 (2)b speaks of the Water Availability Charge <br />(W.A.C.). At the present time, there is another charge <br />besides the W.A.C. This charge is a late hook up charge <br />of $100.00 for homes in existence at the time of the <br />watermain installation that did not hook up to tho water <br />system by a prescribed date. There are approximately 30 <br />homes that have never hooked up to the City s water <br />system, and if they hook up to the water system now, they <br />must pay this late hook up charge. I recommend adding <br />Section 70.01 (2)c which says that buildings in existence <br />at the time of the watermain installation and that have <br />not hooked up to the water system must also pay a late <br />hook up charge of $100.00. The owners of these buildings <br />have been notified years ago that they must connect to the <br />
