QA 13 <br />MEMO TO: Clerk -Administrator and City Council <br />/'\ <br />FROM: Director of Public Works/Community Development�' <br />DATE: April 23, 1985 <br />SUBJECT: PETITION FROM PROPERTY OWNERS INTERESTED IN DISCUSSING <br />THE EXTENSION OF KNULLWOOD DRIVE <br />Attached please find a copy of the subject petition received on <br />April 19, 1985 and a plat map of the area. The shaded lotyon the <br />- <br />plat map indicatetl.the property owned by the people who sigfiedcu <br />the petition. The petition was circulated by David Hoel. Mr. <br />Hoel is working with Don Gaetke to develop the property. <br />City Code Chapter 26.06 states that when any petition for the <br />making of any public improvements is presented to the Council. <br />The Council shall, by resolution, determined whether or not the <br />petition has been signed by the required percentage of owners of <br />property effected nearby, or as to the sufficency of said <br />petition. City Code Chapter 26.05 states that all local <br />improvements to be paid for by special assessment against <br />benefitted property can be instituted by a petition of at least <br />25 percent number of the benefitted property owners together with <br />a resolution adopted by the affirmed vote of the majority of all <br />of the Council. <br />The petition is signed by approximately 50 percent of the <br />- property owners. However, this petition is insufficient in that <br />the petitioners want to discuss the extension of Knollwood <br />Drive. A more sufficient petition would say "we, the undersigned <br />property owners, petition the City Council to construct utilities <br />(water, sewer, storm sewer, street, etc.") and assess the entire <br />cost against our property. <br />Since the petition is to discuss public improvements with the <br />City, there are several ways the City can respond. I will list <br />the possible responses as follows: <br />1. Explain to the property owners that the petition is <br />insufficient at provide them a sample petition for them to <br />sign that is sufficient.(•n• <br />2. Schedule and informational meeting with all the property <br />owners in the area and furnish a sample petition at that <br />meeting. <br />3. Tell the property owners that the petition is insufficient <br />and have them hold their own meetings. <br />Staff requests direction on this issue. <br />� 1_ SWT/bc <br />
