STANDARD AMENDMENTS <br />On April 3, 1985 Staff prepared the attached memorandum for <br />your consideration recentpresentationgarding tby Al Perezewhichlect includedea. <br />After the recent p <br />discussion of the proposed new amendments, I re-evaluated my <br />original memorandum to determine the validity of the <br />recommendation in view of Mr. Perez's comments. <br />During the April 16 meeting Mr. Perez, besides recommending <br />that we request a public hearing on the new standards, <br />listed three areas where the City Ihould becoctednceCned about <br />these new standards. On April <br />Kelso, who holds the position previously held by Mr. <br />re Pereng <br />at the Minnesota pollution Control Agency (MPCA), onse to <br />Mr. Perez's comments and requested his react ion/resp <br />Mr. Kelso'sthem. The three responseues to eachtareeashfollows: and <br />1. The old standards refer to <br />fact thatic's health, <br />they <br />were established to protect <br />safety, and welfare and the proposed new standards do <br />not. <br />According to Mr. Kelso, the proposed new standards do <br />not include this reference as it was felt to be <br />redundant in view of the fact Mthatrthe <br />erenabling <br />these <br />legislation establishing refers <br />tothe <br />as reasons for their existence and promulgation <br />of rules. Mr. Kelso did state, however back tht them <br />would more than likely put this language <br />view of comments they have received. <br />Z. The proposed new <br />forstandards <br />ionalhave <br />noise enforcementfor <br />and <br />theair <br />the Leq <br />the Ldn for planning. This would make <br />standardfwhent <br />if not impossible to enforce the Leq <br />the airport is allowed to be designed using an Ldn <br />standard. <br />Mr. Kelso pointed out, and I confirmed on page 3 of <br />documents included with the Notice of Intent, that <br />the Ldn in <br />standardstaTherintentdiseaddition <br />q <br />thutair would be <br />expected to comply with both standards. Also, there <br />is no rule regarding what standard must be used icted <br />L planning, just that their operations will be exp• <br />to comply with both standards. <br />
