A i= <br />MEMO TO: MAYOR AND CITY <br />FROM: CLERK-ADMINISTR <br />DATE: MAY 13, 1985 <br />SUBJECT: REVIEW OF MUNICIPAL CODES CHAPTERS 100, 101 AND <br />102 <br />Police Chief Ramacher and I have reviewed the referenced <br />chapters of the Municipal Code per the schedule established <br />by Resolution No. 1856 and wouLd submit the following <br />recommendations for changes. <br />Chapter 100 - Intoxicating Liquors <br />1. 100.01, Subdivision 5 - The definition of minor <br />might be changed to 21 dependent upon action of <br />the Legislature during this session. Should the <br />the definition be changed, this subdivision will <br />be revised to reflect that change at the time the <br />new code is adopted. <br />2. 100.02, Subdivision 2 - Due to recent changes in <br />State Statutes the last sentence of this subdivi- <br />sion should refer to Minnesota Statutes 340.11, <br />Subdivision 5A. <br />3. 100.09, Subdivision 1 - This section prohibits the <br />sale of intoxicating liquor between the hours of <br />1:00 a.m. and 8:00 p.m. on election days. As has <br />been discussed in the past State Law, which also <br />prohibited such sales was repealed during the 1984 <br />Legislative Session and several cities in the State <br />followed suit. The City of Mounds View however, did <br />not and we have received numerous complaints from <br />our liquor operators on this matter. Attached is a <br />copy of a memorandum dated December 7, 1985 <br />outlining the issue and recommending that the City <br />continue to retain the provisions of this section of <br />the Code. Staff's position on this matter is the <br />same as that outlined in the December 1984 memo. <br />staff recommends no changes to Chapter 101, Non -Intoxicating <br />Liquors, and Chapter 102, Intoxicating Liquor - Prohibited <br />Sales. <br />OFP/mjs <br />Attachment: <br />
