jtlltiL� <br />MEMO TO: MAYOR AND CITY COUNCIL <br />FROM: CLERK-ADMINISTRATO r/W <br />DATE: MAY 29, 1985 <br />SUBJECT: MUNICIPAL CODE CHAPTER 400 ADMINISTRATIVE OFFENSES <br />During the past few months City Attorney Richard Meyers, Police <br />Chief Ramacher and I have been reviewing an idea originally <br />proposed by Attorney Meyers that would remove all non-moving <br />traffic violations and the majority of Municipal Code violations <br />from the jurisdiction of the Ramsey County Municipal Court and <br />place them under the jurisdiction of the City of Mounds View by <br />establishing an Administrative Offense Code making these offenses <br />and Administrative Offense with fees being collected by the City <br />of Mounds View and establishing a Hearing Officer for purposes of <br />hearing appeals to the charges. Currently these fees are <br />collected by the County with a 50-50 split of revenue. The City <br />should experience a minimum increase of $20,000 if this change <br />was approved. <br />Essentially, the Code would provide that the City's various <br />departments would be able to issue complaints for those offenses <br />regulated by the Code, allow the violator the opportunity to pay <br />the fee established by resolution should the Code be adopted or <br />be heard by an administrative official who would then make a <br />determination as to whether or not the penalty would be waived or <br />amended based on the facts in the individual situations. <br />In order to implement this Code, the following actions would be <br />necessary by the City: <br />1. Printing of the Administrative Offense Complaints <br />using a format similar to that used by the City of <br />St. Paul where the violator is given a hard copy <br />of the complaint with a penalty schedule on the back <br />side and a self-addressed mailer envelope. This <br />could easily be done by one of the local printing <br />firms in the Twin City Area. A copy of the general <br />format of the proposed complaint form is attached <br />for your information. <br />2. Establishment of procedures for the collection of <br />these fees and maintenance of records. I have been <br />advised by Finance Director Brager that the City's <br />cash register could be programmed to allow for <br />easy collection of these fees and in view of our <br />current micrographic program adequate filing <br />cabinet space should be available for the purpose <br />of filing these complaints. <br />
