STAFF REPORT <br />CASE: 176-85 <br />PAGE TWO OF THREE <br />r <br />SETBACKS <br />Proposed structures, paving and curbing all meet minimum setback <br />requirements. <br />ACCESS <br />Applicant proposes two access points, one from County Road I and one <br />from Mounds View Drive. Any joint access must meet the requirements <br />of City Code, Chapter 40.07, Subd. K. <br />DRAINAGE <br />;he site does not need to be reviewed by Rice Creek Watershed <br />District due to its small size (less than 2.5 acres). The applicant <br />satisfies the City's Ordinance No. 49 requirements for drainage on <br />the site. <br />PARKING <br />City Code requires 124 spaces. Applicant proposes 109 regular spaces <br />and 2 handicapped spaces. The total number of spaces does not seem <br />adequate for the use being proposed. Please note that 2.5 feet of <br />many of the parking spaces overhangs grass. This was done to provid' <br />additional green space. <br />There is a conflict in the Code that I have discussed with the <br />Planning Commission in the past. The conflict is that City Code <br />Section 40.05, Subd. C(d), states that vehicle parking or loading <br />docks shall not be located within the minimum required setback. <br />While on the other hand, City Code Section 40.07, Subd. F (3), states <br />that accessory off-street parking shall be not less than 5 feet from <br />any lot line. In the past, we have interpreted this to mean that <br />accessory off-street parking shall not be less than 5 feet from any <br />lot line. <br />Note: B-6-18 curbing will be required for the paved portion of the <br />access parking. <br />CONDITIONAL USE PERMIT REQUIREMENTS <br />City Code does not require a conditional use permit. <br />LIGHTING (City Code 40.07, Subd. D, Paragraph (B)L). <br />1. Is lighting reflected away from adjoining property, abutting <br />residential uses and public right-of-way? <br />2. Is lighting in compliance with Section 40.04, Subd, I and Sectio- <br />40.04, Subd, II? <br />
