August 28, 1985 <br />Page 2 <br />A requirement of written nc:tice on an appeal of an assessment was <br />added to Chapter 26.10 Subdivision 1 in order that the City be <br />made aware ut an appeal prior to or at the assessment hearing. <br />This provision makes the City aware of an appeal early in the <br />process and could savc the City a sobStantiAI Amnnnt of rime And <br />money. <br />City Attorney Meyers advises that the phrasu " ..or if three days <br />notice thereof be published in the newspaper", is not necessary <br />and may be. deleted trom Chapter 26.10 Subdivision 2. <br />The added language in Chapter 26.12 makes this Chapter consistent <br />with the requirement in Chapter 26.10 Su4division 1 that written <br />notice of an appeal be required prior to or at an assessment <br />hearing. <br />Subdivisions 5,6,7 i 8 have been added to Chapter 26.13. These <br />subdivisions allow the issuance o` temporary improve,nent bonds <br />and include provisions of Minnesota Statutes which pertain to <br />investment of proceeds of temporary impro,ement bonds and <br />reference provisions of the Federal Limitations Act whic'i I <br />understanu apply to us w'iether they are included in our Code or <br />not. <br />Chapter 26.14 provides that the costs of certain City servi,:es <br />may be assessed against property owners. Additions to this <br />section would allow the property owner the option of performing <br />the work by himself or herself. '_n addition the property owner <br />would he given the option to pay charges prier to the assessment <br />roll being adopted should the property owner choose to have the <br />City pertorm the work. <br />Chapter 26.24 made reference to provisions of Minnesota Statutes <br />444.075 and specific ammendments to that Chapter.
