MEMO TO: MAYOR AND ri rY cuI1N(, <br />FROM: CLERK -ADMINISTRATOR <br />DATE: NOVEMBER 14, 1985 <br />SUBJECT: DRAM SHOP INSURANCF REQUIREMENTS <br />Attached to this memorandum please find a copy of a letter <br />roceived by the four licensed on -sale intoxicating liquor <br />estabiisnino:O owners i,i the City ,ri Mounds Virw Toque:tiny <br />consideration of a reduction in the City's present insurance <br />requirements. <br />As indicated in this letter the City of Mounds View <br />presently requires insurance coverage in the amount of <br />$100,060 per person, $300,000 per occurrence involving two <br />or more persons, $10,000 for property damage, S100,000 per <br />person for loss of support and $300,000 per occurrence for <br />two or more persons for loss of support. <br />The State Law, M.S. 340a.409, Subdivision I (l), (2), (3), <br />and (4) presently contain the minimum statutory requirements <br />for retail liquor establishments in the State of Minnesota. <br />These requirements are as follows: $50,000 for bodily <br />injury, 5100,000 for bodily injury to two r.. -_-e pprsnns at <br />any one occurrence, $10,000 property damage, $50,000 for <br />loss of support for any one person, and S100,000 for loss of <br />support involving two or more persons in any one <br />occurrence. An aggregate policy limit of $300,000 per <br />policy or may be included in the policy provisions or a <br />deposit with the State Treasurer in the amount of $100,000 <br />in c..^h or securities <br />After discussing this natter with City Attorney Meyers, it <br />has been geierally concluded that this is a policy decision <br />on the part of the City Council ana that as long as the <br />o,inimum State requirements are provided by t.,e licensees to <br />the City of Hounds View, the City will face no liability <br />for incidents occurring at our licensed liquor establish- <br />ments. T'ie signatory to the letter have requested that they <br />lie advised that this item will be on the agenda in order <br />that they might be present to state their case and Staff has <br />contacted each signator personally to advise them of that <br />tact. <br />Should you have any questions of either myself or City <br />Attorney Meyers prior to the November 18th agenda session, <br />please do not hesitate to contact me. <br />DFP/mis <br />
