V., No. 20 FIRE DEPARTMENT CONTRACT The three cities recentTy received a response from the Fire uepartmer to : r pr;f:^ .d new contratt for the ratiud 1986 through 1990. It would appear from that response that, except for one issue, we will be able to agree on new language with minimal difficulty. The exception is that the cities had proposed the removal of a clause in the contract known as Duty of Care which essentially provides that the department would be protected from all liability except where negligence was involved on their part. The Chios proposed this article be replaced with a provision requiring indemnification by the department as we presently require of all private contractors. The department's attorney has taken the position that the department is an agent of the three cities and we contend that they are a contractor as if they were an agent we would have control over their operations and since we currently do not they are more of a contractor then an agent. It would seem that this diclute will end uD needing to be resolved between the attorneys which could drag the process out, however, I am comfortable that we will be able to resolve our differences quickly and amicably. A meeting of the three City Administrators has been scheduled for the morning of November 22 to prepare our counter -response to their proposals. COMPUTER DEMONSTRATIONS As previously indicated, the department head team has invited three firms to give us demonstrations of the computer equipment they proposed in response to our request fur oroposals. These demonstrations have been scheduled for the week of December 2 with the schedule being as follows. December 3, 1985 8:30 a.m. Data Management Design December 1, 1985 8:30 a.m. NCR December 5, 198S 9:30 a.m. Computoservice All of these demonstrations will require a good share of the day for the department head team, however, the Computoservice demonstration will be held at their corporate headquarters in Mankato and the department head team anticipates that it would be gone for the entire day of December 6. Once these demonstrations are completed the Ceam will again meet to determine whether additional demonstrations are necessary or a logical winner has resulted tram the process.
