V., No. 20 <br />FIRE DEPARTMENT CONTRACT <br />The three cities recentTy received a response from the Fire <br />uepartmer to : r pr;f:^ .d new contratt for the ratiud 1986 <br />through 1990. It would appear from that response that, except <br />for one issue, we will be able to agree on new language with <br />minimal difficulty. The exception is that the cities had <br />proposed the removal of a clause in the contract known as Duty of <br />Care which essentially provides that the department would be <br />protected from all liability except where negligence was involved <br />on their part. The Chios proposed this article be replaced with <br />a provision requiring indemnification by the department as we <br />presently require of all private contractors. The department's <br />attorney has taken the position that the department is an agent <br />of the three cities and we contend that they are a contractor as <br />if they were an agent we would have control over their operations <br />and since we currently do not they are more of a contractor then <br />an agent. It would seem that this diclute will end uD needing to <br />be resolved between the attorneys which could drag the process <br />out, however, I am comfortable that we will be able to resolve <br />our differences quickly and amicably. <br />A meeting of the three City Administrators has been scheduled for <br />the morning of November 22 to prepare our counter -response to <br />their proposals. <br />COMPUTER DEMONSTRATIONS <br />As previously indicated, the department head team has invited <br />three firms to give us demonstrations of the computer equipment <br />they proposed in response to our request fur oroposals. These <br />demonstrations have been scheduled for the week of December 2 <br />with the schedule being as follows. <br />December 3, 1985 8:30 a.m. Data Management Design <br />December 1, 1985 8:30 a.m. NCR <br />December 5, 198S 9:30 a.m. Computoservice <br />All of these demonstrations will require a good share of the day <br />for the department head team, however, the Computoservice <br />demonstration will be held at their corporate headquarters in <br />Mankato and the department head team anticipates that it would be <br />gone for the entire day of December 6. <br />Once these demonstrations are completed the Ceam will again meet <br />to determine whether additional demonstrations are necessary or a <br />logical winner has resulted tram the process. <br />
