City Council Resolution No. 1979 dated <br />February 10, 1986 <br />The applicant received approval ro rezone his property from <br />R-1 to R-2 and subdivide the property in June, 1981. The <br />applicant had never bull' a dupiex on the subdivided iot. <br />In 1985 the applicant derided to buila a single-family house <br />on the subdivided lot. Building permits were issued, <br />construction commenced and has now been completed. The <br />problem is that M:. Enberg never filed the subdivision with <br />the County. City Code states that the applicant must record <br />the subdivisicn with the County within f0 days of approval <br />of the subdivision. I assume he did not file this with the <br />County because he did not want to pay the increase in <br />property taxes that would result from a subdivided <br />property. Therefore, he needs approval for the minor sub- <br />division. The rezoning from R-1 tc R-2 is a moot point <br />because he has already c,�nstructed a single-family house on <br />the lot. <br />The property is nor in a wetland or a floodplain zone. The <br />subdivision satistios all City Code requirements. <br />RECOMMENDATION: I recumwend approval of this min>r <br />subdivision. <br />SWT/mis <br />Attachments: <br />
