Mounds View City Council April 14, 1986 <br />Regular MCC -ling Page Three <br />------------------------_-----_-----------_-_-_----_-------------------- <br />id Mr. Povlitzki stated that Mr. Povlitzki has the <br />fight to approve the buyer during a sale, which was <br />a provision meant to protect Mr. Povlitzki from <br />someone coming in and running the building down <br />while he still had a considerable financial obliga- <br />tion open, but in the past three and a half years <br />since Mr. Loosen purchased this from Mr. Povlitzki, <br />he has reduced the debt significantly. He also <br />explained that he has filed a separate lawsuit <br />against Mr. Povlitzki, unrelated to this transfer, <br />and Mr. Povlitzki has stated he is willing to allow <br />the business to be sold only if Mr. Loosen will <br />drop the lawsuit. <br />Attorney Meyers advised that Mr. Loosen could allow <br />the applicants to move in but he would still be <br />liable. fie added the only issue before the Council <br />is whether this is a valid transfer, and they must <br />stick with that issue. <br />Mr. Povlitski stated the City is going to become <br />involved in the lawsuit Mr. Loosen had referred to, <br />as it involves parking anu what the requirements are. <br />Mayor Linke closed the public hearing and reopened <br />he regular meeting at 7:27 PM. <br />Motion/Second: Linke/Quick to approve the transfer <br />of the on -sale intoxicating liquor license for <br />5 ayes 0 nays Motion Carried <br />Attorney Meyers stated the lease between the applicants <br />and Mr. Looser is �,alid as far as he is concerned, <br />until he is told differently by a court of law. <br />Park Director Anderson introduced Frank Quam of 6. Residents <br />Honeywell, who made a donation, on behalf of Honeywell, Requests and <br />for the Neighborhood Park Planning Fund. Comments from <br />the Floor <br />Park Director Anderson thanked Mr. Quam and Honeywell <br />for the continued sponsorship of this program, which <br />have gone to the creative play area at Groveland Park. <br />Clerk/Administrator Pauley read proposed Resulutiun <br />No. 2001. <br />Motion Second: Quick/Hankner to approve Resolution <br />vo.
