Wirv! <br />COIINTY OF RAMS'!" <br />tirA'1E OF MINNKSO'I'A <br />RECOMMENDATION TO '['UP CITY COUNCIL RI•:GAROLNG MOUNDS <br />VIKW PLANNING CASE NO. 104-04, KUNZ OIL COMPANY <br />WHEREAS, Kunz Oil Company has requested City approval to <br />remove their existing building and construct a gasoline/convenience <br />sLore in the City of Mounds View; and <br />WHEREAS, construeLinn of this gasniine/ennveniance store <br />tacit-i.ty as requested requires approval of Lho development and <br />conditional use permit; and <br />WHEREAS, the Planning Commission has reviewed the staff <br />ruport and has reviewed Lhe report on the development from <br />Northwest Associated Consultants, Inc. along with information <br />submitted by the applicant which includes the following; <br />a) DovelopmenL Plan <br />b) Site Survey <br />c) Project Summary <br />d) Evidence of. Site Control <br />e) Landscaping Plan; and <br />WHEREAS, the Planning Commission has also reviewed this <br />proposal and it is in conformance with all Chapters of the, <br />Municipal Code, specificaLly Chapters 40, 42, 49 and 49A, and State <br />Statutes; and <br />WHHRKAS, this development does not need to be reviewed by <br />the Rice Creek Watershed District; and <br />WHEREAS, the Minnesota Department of. Transportation wil, <br />review the development prior to construction; and <br />WHEREAS, the Planning Commission reviewed the letter. from <br />Attorney Mayers dated January 26, 1985 that states a City simply <br />cannot legislate a business out of existance; and <br />WHEREAS, the storm water control shall be approved by the <br />CiLy Engineer prior to approval by the City Council; and <br />WHEREAS, the Mounds View Planning commission conducted an <br />informational meeting with the residents of l:he area on February 6, <br />1985 at 7:40 p.m.; and <br />M <br />
