MEMO TO: Clerk -Administrator and City Council <br />r� FROM: Director of Public Works/Community Development <br />i <br />DATE: September 18, 1986 <br />SUR3ECT: VACATING PART OF THE SEWER EASEMENT AT 8106 <br />GROVELAND ROAD, PLANNING CASE NO. 198-86 <br />Attached please find the following: <br />1. Planning application dated 5/15/86 <br />2. Plat map indicating the location of the easement <br />3. Planning Commission Resolution No. 172-86 <br />4. Resolution No. 2092 dated 9/22/86 <br />Mr. 8lasberg constructed a house at 8106 Groveland Road in 1979. <br />The house was constructed over a 40' wide sewer easement. The <br />problem was noted in a title opinion conducted in 1986. One <br />other title opinion conducted on this property did not locate or xA <br />identify the easement. <br />City Attorney Meyers and myself have reviewed :;his issue and have <br />determined that the sewer easement under the house is not needed <br />by the City. The Planning Commission reviewed this item at their <br />Agenda Session on September 17, 1986. The Planning Commission <br />recommends vacating the sewer easement under the subject house. <br />RECOMMENDATION: City Attorney Meyers and myself recommend <br />vacating the easement per Resolution No. 2092. <br />SWT/bac <br />l� <br />
