Meeting d�nI �/ nSeptember 3, 19 <br />PT��-V-�-L-�------------------ <br />Page Three <br />Commissioner Fors.lund staled she would agree with Mr. <br />Gjerde that he does not have access to his back yard and <br />she did not like to see a boat parked on the grass, as it <br />would rip it up. <br />Commissioner. Miller stated she feels Lite planning <br />Commission must uphold Lite Code, which requires a <br />hardship for a variance, and she does not feel Mr. Gjerde <br />has one. <br />Commissioner Y.ollner stated she can sympathize with Mr. <br />Gjerde, but she must go along with the Code, and without <br />a hardship, cannot grant- a variance. <br />Motion/second: Miller/Zollncr to deny the variances for <br />Lite property at 2267 Lois Drive, Case 193-86, and <br />2272 Lois Drive, Case 194-06, due to lack or hardship. <br />3 ayes 1 nay <br />Commissioner rorslund voted against the motion, stating <br />she felt it was a pre-existing condition, and lie only <br />needs about a 24 foot variance since the garage is <br />closer than 5 feet from the property line. She added <br />she would rather see them park on the concrete drive- <br />way than on the grass. <br />Commissioner Miller slated that since the Code states <br />U-1: anything which is replaced to a degree of more <br />than 50 percen,_ must be brought up to Cnde, she feels <br />the driveway should be placed 5 feet from the properly <br />line, as specified in the Code. <br />Chairman Mountin stated the applicants can appeal the <br />Planning Commission's decision to the City Council. <br />Director Thatcher reported the next Council agenda <br />session is September 15, and he requested the <br />LO111`1` <br />anLs submit a letter. stating that they wishcal Lite denial. <br />Director. Thatcher reviewed the history.of Dynamic <br />Designers briefly. Ile also stated that, in response <br />to Lite Planning Commission's question of whether <br />any furthor fill could be placed on the property, he <br />has determined that a minimal amount could still be <br />Placed without causing any problems. Ile added that <br />this wetland will not he changed with any future <br />storm sewer system. Director Thatcher also pointed <br />out the applicant was in the process of filling the <br />property when Lite City enacted File moritorium on the <br />wetlands, and had Lite moritorium not been imposed, <br />they could have filled Lite property and built on it. <br />Motion Carri <br />7.
