Based upon our review of the information constituting <br />i( other appropriate factors, and recognizing the uncertainty <br />as to judicial interpretations of the 1984 Federal Cable <br />Act, it does not appear that there is any legally Justifi- <br />able reason to withhold approval of the transfer to North <br />Central in the areas of legal orrtechnical. <br />The area of financial ability to perform the franchise <br />commitments appears to be the only remaining question for <br />the Commission's consideration, albeit an extremely signifi- <br />cant consideration. Depending upon the policy determination <br />regarding the viability of the financial plan and the <br />associated guarantee of performance, or lack thereof, Com- <br />mission staff is prepared to prepare the necessary documen- <br />tation to approve or deny the transfer of ownership. <br />- 16 - <br />
