V. CONCLUSION <br />The area of financial ability as part of the Commission's <br />consideration of this Request For Approval, appears to be <br />the only remaining issue, albeit an extremely significant <br />factor. The question of the financial ability of North <br />Central at this stage of our investigation results in a <br />policy determination for the Commission and its member <br />cities. It has been concluded that the financial pro formas <br />of North Central as presented do not represent a financially <br />viable plan. However, North Central has endeavored to sup- <br />port its financial plan by the commitments and assurances <br />stated above. It can be concluded that North Central's <br />financial plan based upon the information we have reviewed <br />does present a risk to Mr. Hauser. While the risk to the <br />Commission, its member cities and the franchise commitments <br />is a policy decision for the Commission, it would be my <br />opinion that, based -upon the totality of the circumstances, <br />the Commission could not reasonably deny the transfer to <br />North Central. To this end, it would be my opinion that if <br />the Commission or its member cities were to deny the trans- <br />fer based upon the information provided, a court would <br />likely conclude that the denial was unreasonable. <br />- 5 - <br />
