STAFF REPORT PAGE TWO OF THREE <br />CASE NO. 172-05 <br />�I <br />SETBACKS <br />Proposed structures, paving and curbing all meet minimum setback <br />requirements. <br />ACCESS <br />Applicant proposes three access points (two access points from <br />County Road I and one access from Hounds View Drive). One access <br />on County Road I must be a joint access and City Code Chapter <br />40.07, Subd. K, must be satisfied. <br />DRAINAGE <br />The site does not need to be reviewed by Rice Creek Watershed <br />District due to its small size (less than 2.5 acres). The <br />applicant satisfies City Ordinance No. 49 requirements for <br />drainage on the site. <br />PARKING <br />City Code requires 50 spaces. Applicant proposes 55 spaces <br />ii,cluding 18 spaces at the pumps and one handicapped space. The <br />total spaces are adequate for the proposed use. <br />Note: B618 curbing will be required for the paved portion of the ry <br />access parking. <br />CONDITIONAL USE PERMIT REQUIREMENTS <br />City Code requires the City Council to conduct a public hearing. <br />Conditional Use Permit Section 40.18, Subd. DM requirements for <br />motor fuel station: ' <br />1. All requirements of this section are complied with except for <br />the following: <br />(a) Paragraph (b) - Is the proposed building and site so <br />dissimilar to the existing buildings or area as to cause <br />impairment in property valves or blight? <br />(b) Paragraph (g) - Will lighting meet the requirements of <br />this paragraph and Section 40.04, Subd. 11, Subd. I, and <br />Subd.
