DRAFT <br />RESOLUTION NO. 2363 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTION DENYING THE VARIANCE REQUEST FOR THE <br />HARSTAD DEVELOPMENT PROPOSAL KNOWN AS GREENFIELD ESTATES <br />WHEREAS, Harstad Companies has requested approval of a <br />single family development prone=al known as Greenfield Estates; <br />and <br />WHEREAS, Harstad Companies has requested the following in <br />order to construct their proposed development: <br />1. Major subdivision (17 single family homes) <br />2. 'Wetland zoning district map amendment <br />3. Wetland alteration permit <br />4. Variance from a) 100 foot wetland setback requirement, <br />b) 125 foot minimum lot width as measured at the <br />building setback line, and c) 20,000 square foot <br />minimum lot size <br />5. Vacation of right-uf-way (ROW) <br />6. Park land dedication credit <br />r <br />7. Conditional use permit for working in the flood plain; and <br />WHEREAS, the City Council, Planning Commission, City Staff <br />and the City's Engineering Consultant have reviewed this <br />development request; and <br />WHEREAS, this development * ;t conform to the requirements <br />of Chapters 4U and 42 of the Municipal Code and Chapters 48, 49 <br />and 49A because this development is in a wetland zoning district <br />and a flood plain; and <br />WHEREAS, Chapter 48.05, Subd. 5 A, B and C requires all <br />land proposed to be subdivided and lying within a wetland zoning <br />district to have the following: <br />A. Minimum lot size - 20,000 square feet <br />B. Minimum lot width - 125 feet as measured at the <br />building setback line <br />C. All structures shall be setback at least 1GO feet <br />from the wetland; and <br />WHEREAS, the City Council has seen fit to develop these <br />re4ui-ements to regulate the wetland because the Council has <br />founa the following: <br />
