DRAFT RESCLJTION NO. 2363 <br />PAGE THREE <br />M <br />(6) The variance would not be materially detrimental to <br />the purpose of this Code, or to other property in the <br />same zone. <br />(7) <br />The proposed variance will not impair an adequate <br />supply of light and air to adjacent property, or <br />substantially increase the congestion of the public <br />streets, or increase the danger of fire or endanger <br />the public safety, or substantially diminish or impair <br />property values within the neighborhood. The Hoard of <br />Adjustment and Appeals may impose such restrictions <br />and conditions upon the promises benefitted by a <br />variance as may be necessary to comply with the <br />standards established by this Code, or to reduce or <br />minimize the effect of such variance upon other <br />properties it the neighborhood, and to better carry <br />out the intent of the variance. <br />WHEREAS, <br />the City Council makes the following findings: <br />Findings <br />(1) <br />The City Council finds that the 20,000 square foot lot <br />size, the 125 foot lot width, and t1ae 100 foot setback <br />r <br />accomplishes the goals of Chapter 48. <br />(2) <br />The City Council finds that the granting of a variance <br />for the lot uize, lot width, or 100 foot setbck would <br />be against the intent of GT<apter 48 of the Municipal <br />Code. <br />(3) <br />The City Council finds that this property does not <br />have any exceptional or extraordinary circumstances <br />that apply to the properties which do not apply <br />generally to other properties in the same zone or <br />vicinity and result from lot size or shape, topography <br />or other circumstances over which the owners of the <br />property since enactment of this Code have no control. <br />(4) <br />The City Council finds the literal interpretation of <br />the provisions of Chapter 46 would not deprive the <br />applicant of rights commonly enjoyed by other <br />properties in the same district under the terms of <br />this Code. <br />(5) <br />The City Council finds that the special conditions or <br />circumstances result from the actions of the <br />applicant. <br />(6) <br />The City Council finds that granting the variance <br />requested will confer on the applicant a special <br />privilege that is denied by this Code to owners of <br />other lands, structures or buildings in the same <br />district. <br />
