MEMO TO: MAYOR AND CITY COUNCIL <br />FROM: CLERK -ADMINISTRATOR <br />DATE: AUGUST 16, 1998 <br />SUBJECT: LEGAL REPRESENTATION ON WILLIAMS PIPE LINE <br />LITIGATION <br />Attached please find a letter from City Attorney Richard <br />Meyers outlining a proposed agreement between the City of <br />Mounds View and Messrs. Meyers, Eric Valen and William <br />Foster relative to the representation of the City of Mounds <br />View in our litigation against Williams Pipe Line Company. <br />Essentially, Mr. Meyers proposes that the City of Mounds <br />View pay the three attornies a rate of $50.00 an hour for <br />continuing legal representation except for hours in trial <br />status when Mr. Foster would be, paid a rate of $150.00 per <br />hour. Should the city succesfully litigate tnis matter and <br />receive financial compensation from Williams Pipe Line <br />Company, the award shall first be applied to City expenses <br />and actual property damage. After that, the City' shall <br />reimburse Messrs. Meyers, Valen and Foster for their hours <br />spent on this case at the rate of $150.00 per hour. After <br />these reimbursements have been made, should anyDtadditionalen <br />al <br />funds be available, the City would pay - <br />and Foster additional compensation in the amount of 15% of <br />any excess funds. <br />Based upon previous discussionsO17ith Mr. Meyers <br />rsion this <br />ion. <br />matter, I am presenting it to y Y <br />Should it be your desire to approve this item at your <br />August 22 council Meeting, I would recommend that the motion <br />be to approve the agreement with Messrs.
